Terms and Conditions

These terms and conditions govern the provision of photography services by Tinyfoot Photography ("we", "us", "our") to clients ("you") in Sydney, Australia. By booking our services you agree to these terms.

1. Booking and Payment

A booking is confirmed upon receipt of a signed booking agreement and deposit. The deposit is non-refundable and secures your date exclusively. The remaining balance is due seven days prior to the event date.

2. Cancellation and Rescheduling

If you need to reschedule, please contact us as soon as possible. We will make every effort to accommodate a new date subject to availability. Cancellations within 14 days of the event date forfeit the full booking fee. Cancellations outside 14 days forfeit the deposit only.

In the unlikely event that we are unable to attend due to illness, emergency, or circumstances beyond our control, we will make every effort to find a suitable replacement photographer of equivalent standard. If no suitable replacement can be found, a full refund will be issued.

3. Copyright and Licensing

All photographs taken by Tinyfoot Photography remain the intellectual property of Tinyfoot Photography. We grant clients a personal, non-exclusive, non-transferable licence to print and share their images for personal use only.

Images may not be used for commercial purposes, stock photography, or sold to third parties without our express written consent.

4. Portfolio and Marketing Use

We may use selected images from your session for portfolio, website, and social media purposes unless you expressly request otherwise in writing prior to your event. We will never publish images that are inappropriate, unflattering, or that you have specifically asked us not to publish.

Photography of children: We will only publish images of children to our website or social media where we have received explicit written consent from a parent or guardian. Consent is obtained as part of the booking process. You may withdraw consent at any time by contacting us in writing.

Images of naked or semi-clothed children: We will never publish such images publicly under any circumstances, regardless of consent.

5. Image Delivery

Edited images are delivered via a private online gallery within two to three weeks of the event. The gallery remains accessible for 90 days from delivery. We strongly recommend downloading and backing up your images promptly. We are not responsible for images lost after the gallery expiry period.

6. Church and Venue Restrictions

Some churches and venues impose restrictions on photography including flash photography, movement during the ceremony, and positioning. We will always comply with these restrictions. We cannot be held responsible for limitations on coverage imposed by the venue.

7. Liability

In the event of equipment failure, accident, or unforeseen circumstances that affect the quality or quantity of images delivered, our liability is limited to a refund of fees paid. We are not liable for any consequential, indirect, or special damages.

We recommend that clients do not solely rely on professional photography to document their event and encourage family members to take their own photographs as well.

8. Conduct

We reserve the right to cease coverage and leave an event if we are subjected to harassment, abuse, or unsafe conditions. In such circumstances no refund will be issued.

9. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
